If he is found innocent at the retrial I don't see why not. It's probably too early to say, but with the original sentence quashed as "unsafe" the prosecution have got the harder job to prove his guilt.
Probably going to get rapped over this, but if he is found innocent it will be yet another one of those cases where the word "consensual" has been misinterpreted to the detriment of the man........
